1) Personal Injury: I understand that this waiver means I, on behalf of myself and/or on behalf of my minor child(ren) give up my right to bring any claims including those for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim against Premier Athletics, its staff, or any entity in charge of the location used in their events. I, on behalf of myself and/or on behalf of my minor child(ren) will not seek damages, whether known or unknown, foreseen or unforeseen against Premier Athletics, its staff, or any entity in charge of the location used in their events. CHOICE OF LAW: I understand and agree that the laws of the State of West Virginia and Ohio will apply to this contract.
2) Property damage or loss: I, on behalf of myself, my family or friends, and/or on behalf of my minor child(ren) will not seek property damages, whether known or unknown, foreseen or unforeseen against Premier Athletics, its staff, or any entity in charge of the location used in their events. CHOICE OF LAW: I understand and agree that the laws of the State of West Virginia and Ohio will apply to this contract.
3) COVID-19: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Premier Athletics, U.S.A., 204 Abritt Dr, Washington WV 26181, cannot prevent you and/or your minor child(ren) from becoming exposed to, contracting, or spreading COVID-19 while utilizing any facility used to host an event by Premier Athletics. This also includes any premises the event may use or consuming the concessions provided at the premises. It is not possible to prevent against the presence of the disease. Therefore, if you and/or your minor child(ren) choose to utilize Premier Athletics event premises, and/or enter onto said premises, you and/or your minor child(ren) may be exposing yourselves to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 on behalf of myself and/or on behalf of my minor child(ren), in order to utilize Premier Athletics premises, i.e. baseball/softball fields, bleachers, parking areas, concession stands, and/or concessions sold at said premises of their event. The use of these premises are of such value to me and my minor child(ren), that I accept the risk of being exposed to contracting, and/or spreading COVID-19. WAIVER OF LAWSUIT/LIABILITY: I, my Heirs, Assigns, Personal Representatives, Executors, and Administrators, on behalf of myself and/or my minor child(ren), hereby forever release and waive any and all rights to bring suit against the City the event is taking place and/or Premier Athletics, U.S.A. and their owner connection with exposure, infection, and/or spread of COVID-19 related to utilizing Premier Athletics event facility, baseball/softball fields, bleachers, parking areas, concession stands and/or concessions sold there.
4) Consent of Media & Imagery: I give Premier Athletics permission to use my event pictures taken at Premier Athletics events in future advertising which will include the internet and social media.
5) Proper Authority: You confirm that you are at least 18 years of age and are either the team’s coach or an individual with proper authorization to register the team on behalf of its members.
